Gov. Brown Taxes Internet: Amazon Drops 25,000 Businesses in CA

    Gov. Jerry Brown has signed into law California's tax on Internet sales through affiliate advertising which will immediately cut small-business website revenue 20% to 30%, experts say.
    The bill, AB 28X, takes effect immediately. The state Board of Equalization says the tax will raise $200 million a year, but critics claim it will raise nothing because online retailers will end their affiliate programs rather than collect the tax.
    Amazon has already emailed its termination of its affiliate advertising program with 25,000 websites. The letter says, in part:
    (The bill) specifically imposes the collection of taxes from consumers on sales by online retailers - including but not limited to those referred by California-based marketing affiliates like you - even if those retailers have no physical presence in the state.
    We oppose this bill because it is unconstitutional and counterproductive. It is supported by big-box retailers, most of which are based outside California, that seek to harm the affiliate advertising programs of their competitors. Similar legislation in other states has led to job and income losses, and little, if any, new tax revenue. We deeply regret that we must take this action.
    The new law won't affect customers, Amazon said, but added that the immediate termination of the affiliate program also applies to endless.com, myhabit.com and smallparts.com.
    (Full disclosure: I have a personal website that has been an Amazon affiliate. It made $2 last quarter. That is not 30% of my income.)
    Almost all the California Amazon affiliates have fewer than 75 employees and a large percentage have no employees, according to Rebecca Madigan executive director of the Performance Marketing Association, a Camarillo-based nationwide trade association.
    "This law won't impact Amazon that much but it is a crisis for website owners who make revenue by placing ads on their websites for thousands of online retailers," Madigan said. "Most of them don't have a physical presence in California."
    California Retailers Association stated:  "We thank Governor Jerry Brown and the leaders in the California State Legislature who have demonstrated their leadership and commitment to California businesses by passing and signing e-fairness into law. Small and large businesses across the state have been held at a major disadvantage by the current law that out-of-state online companies like Amazon.com and Overstock.com have exploited for years. This has cost us jobs and revenues."
    The U.S. Supreme Court in 1992 ruled that states cannot tax businesses that aren't physically within their boundaries. Such taxes would regulate interstate commerce, which is a federal government prerogative.
    However, New York in 2008 passed a law to require companies with online affiliate advertising programs to collect sales tax for sales through those affiliates based in New York. Since then Rhode Island, North Carolina, Illinois, Arkansas and Connecticut passed similar laws.
    Amazon is suing New York over the law, and the Performance Marketing Association is suing Illinois.
    Amazon affiliate Keith Posehn, owner of zorz.com in San Diego, said he had affiliate advertising agreements with more than 70 companies and these programs were 35% of his company revenue before the California legislature passed a similar bill last year. Then-Governor Schwarzenegger vetoed that bill.
    "We got 70 termination letters in one night before he vetoed it," Posehn said. After that, he started changing his business away from affiliate advertising and has started a new mobile application company.
    "I have pitched investors and several question the wisdom of staying in California," Posehn said. "Some venture capitalists are very keen on placing startups outside California because start-up costs are less."
    However, another Amazon affiliate, Glenn Richards, an independent recording artist in Orange County (MightyFleissRadio.com), is angry with Amazon and its head Jeff Bezos.
    "I think that Amazon.com's decision to throw their affiliates, (including myself) under the bus is a national disgrace," Richards said. "Jeff Bezos should be ashamed of his conduct. His bully boy practice and tactics of extinguishing small business in California should be (condemned). Small business has no power...and no hope to confront Internet giants like Amazon.com."
    Board of Equalization Member George Runner blasted Brown for signing the law. "Even as Governor Jerry Brown lifted his pen to sign this legislation, thousands of affiliates across California were losing their jobs. The so-called 'Amazon tax' is truly a lose-lose proposition for California. Not only won’t we see the promised revenues, we’ll actually lose income tax revenue as affiliates move to other states."

Father of Hailey Dunn Arrested...Again

    Failure to appear...again?

    Big Country:  Clint Dunn has been arrested on two failure to appear warrants: one for possession of marijuana, and one driving while license invalid.

    He was scheduled to be at Mitchell County Court at 9:00 Wednesday morning, and was arrested around 10:15 p.m. the same day.

    According to the Sheriff's office, Dunn said he didn't know he was supposed to be there.

    He is being held at the Mitchell County Jail on a total of $5000 bonds, and if he can't come up with the money he must stay until his court date, which could be up to 90 days

River Cruz on the Stand Q and A




    Question:  Why did the defense call River Cruz?

    Answer:    The defense called River Cruz in an attempt to impeach the testimony of George Anthony.

    Question:   Why?

    Answer:     Because if the defense can show George Anthony as a liar, it "impeaches" or, calls into doubt, the veracity of his prior testimony.

    Question:   Will this work?
    Answer:     Likely not.

    Question:  If the defense shows he lied about his affair, will this raise reasonable doubt for Casey?
    Answer:    No, and here is why:

    Objection:  River says that George said "it was an accident that snowballed out of control" and this could  buttress the defense theory.

    Answer:     Jeff Ashton masterfully got her to say that George believed it.

    Here is my take on it:

    I believe that George had an inappropriate relationship with River Cruz.  I think:

     that George put the touch on her for money; loan or donation.   It is who George is.

    that River sold her story for money.

     that George, in defense of Casey, probably said it was an accident that snowballed out of control.


    George testified truthfully, as did Cindy, at times, and other times, he did not.  This is the Anthonys.

    Readers, resist the temptation to pain with a broad brush.

    What makes a good investigator?

    The number one quality is the ability to accept the unknown; that is, to not have an answer, neatly tied up, in black and white.

    It is something that frustrates us all.

    That George Anthony had an affair with River Cruz, or that George Anthony and Cindy Anthony sold pictures for money, or that River sold her story for money, or Roy Kronk's motivation was both money and fame does not change the basics of the case:

    Premeditated murder.

    Look beyond the lies to the truth.  Discern deception from truth.

George Anthony's Letter to Casey





    In the spring of 2010 almost 14 months before the trial began, George Anthony wrote the following letter to his daughter, Casey.  Given all that has transpired in the past month, the letter is especially interesting.  Commentary follows in bold type.  See original analysis for Statement Analysis.  This is commentary only.

    It would appear that it was at this time that Jose Baez delivered the news:  that Casey was blaming him.   Let's look at the letter again, now with commentary of all that we now know, in bold type:

     It may be: 
    1.  Did you dump the body?
    2.  Did you molest Casey?


    If this was associated with Casey's letter to another inmate alleging sexual abuse, it may be in reference to that abuse, but why 2 questions?

    Or, was it something to do with taking the fall for his daughter?  Given that there were two accusations against George; dumping the body, and molesting Casey, did George learn of the defense's strategy last year?



    Why, Why also destroy Lee...

    Was Casey planning on blaming Lee also?  By what we heard in the opening statement, this is likely. 

    It appears that Casey was successful in her final destruction of the family.  She turned one liar upon another, mother against son, and husband against wife.  The family may find money waiting for them, but they are destroyed and will never be the same again, nor will they ever be a 'family'.  They will struggle to stay together, as guilt tears them apart.  It appears that George has finally admitted that Casey killed Caylee, and he will, no doubt, torment himself considering how he "failed" Caylee.  There will be too many moments where he, and perhaps the others, even consider what they could have done to intervene and save Caylee.  They will consider the moments where they ignored her, knowing she was lying, fearful to learn the truth...

    all the money in the world will not buy them peace. 


    Why, Why also destroy Caylee Marie...

    How did all of this destroy Caylee Marie?  Is it by forcing the family to lie, and dishonor the memory of Caylee?  Is it considered "destruction" when Cindy lied under oath, claiming to make chloroform searches?  Does George consider that by 'forcing' these lies upon the family (as if it was forced) Caylee's memory was being dishonored?

    After all I have tried, sacrificed, continued

    He is unable to come to grips with her sociopathy.  Casey is unable to feel regret or empathy.  She may cry, but only for being caught, not for what she has put her family through for 3 years.  

    For the rest of his life, George Anthony will question himself:

    How did I raise such a monster?
    What could I have done to save Caylee?

    Over and over he will be haunted.  Yet, he felt the fear run down his spine when Jose Baez reminded him of life imprisonment in Florida  for child molestation.  

    Even with millions, he will not know the peace of a conscience at ease with the Creator, as he puts his head on his pillow at night. 

    When the Anthonys hit the spotlight again, and the book comes out and the TV deals roll in, do not envy them.

    Pity them. 

    They will be able to afford fine and fancy foods, but will be without the taste buds of which to enjoy the food. 

    "What does it profit a man to gain the whole world, and lose his soul?"

Susan Smith Trial: Dr. Sally Karioth's Role

    Jose Baez called upon two jail guards to testify and give the psychological profile or opinion of Casey Anthony, as if the two guards were experts.  It went no where.

    Baez then brought on flakey Dr. Karioth, who testified that any scenario presented to her by the State or by the defense would be responded to with the answer, "grief" exposing the fraudulent 'expert' testimony.

    Ashton:  Have you ever worked at at murder trial?

    Dr. Karioth:  yes


    Jeff Ashton:   "you testified at the Susan Smith trial to explain why Susan Smith murdered her children?"

     Dr. Karioth:   "yes"

    The defense objected.

    Judge Perry overruled the defense, who then asked for a side bar.

    Jeff Ashton then took over.  He was able to describe a 'hypothetical' situation and went on to describe Casey's scheming behavior, and how Casey killed her child and made up a scenario to cover her tracks.

    how is it that the defense brought this "expert" witness in?

    The calling of this witness allowed Jeff Ashton to give a preview of his closing argument which leaves a powerful impression upon the jury.

    Consistently, defense witnesses have been turned into State witnesses.

The Mercenary Spirit within "Expert" Witnesses



    Did anyone ever think that someone in the field of mental health would travel to Florida, put all reason and research aside, and attempt to testify that Casey Anthony's partying and celebration was really "grief" and not think that the audience would see through this?

    It is to be expected that an "expert" can be found to say anything, about anyone, at any time, in exchange for money, or the 15 minutes of exposure that can later lead to money.

    During the introduction alone, of the "expert" witness, there were 5 sustained objections as Dr. Sally Karioth would not stop speaking about herself.

    This "expert" may be found on Youtube (talking about herself) and showing how she uses her drama and theatrics (mostly hand motions) in presentations, there is something that should not be overlooked:

    This is a murder trial.

    This is not a game, in spite of what Cheney Mason said.

    Not only is Dr. Karioth willing to testify to help a murderer escape justice, but she is willing to do so without ever speaking to Casey Anthony.

    Her theatrics were contrived, bizarre, and did not belong in a courtroom.  Her incessant rambling only highlighted how the defense has no one, except Casey Anthony, to explain away her deviant, celebratory behavior during the 31 days following her murder of Caylee.

    Dr. Karioth's narcissistic behavior  was not simply evident in the need for 5 sustained objections, but in that she was willing to disgrace herself, her 40 years in grief, and her colleagues who may be working to help others overcome grief, just for an appearance on a nationally televised trial.

    She gave her "expert" opinion, including "in this situation" without even interviewing Casey Anthony.

    She explained that any and every emotion and reaction that takes place within the human realm is related to grief.


    Disgrace. 

    Casey Anthony scowled at George Anthony while he wept, but attempted to cry while the flakey pop-dramatic actress talked about grief.

    Casey wiped her one eye crying, poking, attempting to redden her face.  Jeff Ashton did what he could to stop the incessant talker.

    A great question to ask her would have been:

    is there any human emotion not consistent with grief?

    This would have exposed her as the fraud she is.

Grief Counselor, Dr. Sally Karioth



    Apparently, the defense has found one grief counselor in the country who will testify that celebrations, including dancing, partying, drinking, getting a tattoo and such, is really just expressing grief. 


     Good grief. 


    Dr. Sally Karioth had 5 objections...all because she would not stop talking about herself, even though the questions were simple, requiring only a word or two to answer. 




    "I'm a certified traumatologist"


    All 5 objections were sustained, as Dr. Karioth appears either unable, or unwilling to stop speaking of herself. 


    The state would like to move this along, as likely does the judge and the jury.  Dr. Karioth seems to enjoy looking at the jury, talking about herself, and making lots of hand gestures.


    The defense appears to be on its last witness, unless Casey Anthony is going to take the stand, and this may be their only way of telling the jury that Casey really wasn't celebrating Caylee's death.  By dancing, drinking, buying things and even getting a celebratory tattoo, she was actually grieving.  This is what the 'chicken soup for the soul' contributor is going to testify to.  


    Five objections on her background only.  


    Objection #5 and she hasn't even gotten to the case.




    This can't be all that the Defense has.  It is possible to find anyone to say anything in exchange for fame or fortune, or at least the possibility of such.  This flakey pop-psychology has nothing to do with this murder case.  It has become torturous to listen to. 


    Politely, Mike Galanos called her "eccentric"  but the jury must remain awake.   


    In spite of the State's objection to her as an expert witness, Judge Perry is allowing her as an expert of "grief"


    Judge Perry has bent over backwards for the defense. 


    Even Dorothy Sims had to interrupt her as she goes on and on in her answers.   Dr. Karioth does not appear to be able to answer "yes" or "no" to a single question that calls for such an answer.

Understanding Future/Conditional Tense Usage in Context



    "I would never harm my daughte
    r" in response to an accusation of molestation, must be taken within context. 

    If this is the answer to the allegation, it must be flagged as "would never" is conditional/future tense, that is, unfulfilled at the time of the answer, and, by itself, is weak. 

    If the subject said "I didn't molest my daughter" and then adds "I would never harm her", the denial is strong:  First Person Singular, past tense.  It is not weakened by the additional sentence's inherent weakness. 

    This is because the question has been answered and the subject wishes to distance himself from that which is vile.  Without a strong denial, however, we cannot substitute the weakness of future/conditional tense for a strong, first person singular, past tense, event specific denial. 

    We do not conclude deception on a single indicator of sensitivity, but look at the entire statement in context.  

    For someone who did not molest his child, "I did not molest my daughter" is something that will come without sensitivity indicators.  Once this has been established, it is appropriate for the subject to add that this is something that would never happen.  

    A guilty person will give indicators, that is, indicators plural, of deception.  They will avoid, in open conversation (the free editing process) of choosing their own words and say "I didn't do it."

    We have seen this in suspects who have spoken to the media for months on end, knowing that many suspect them, yet never openly stating, "I didn't do it."

    For the guilty, "I would never" is easier to say than the stressful oppositional lie of "I didn't do it", yet the future conditional should be viewed in context. 

    By itself:   it is not reliable.  If the context shows deception, then the subject likely did it and "wouldn't" do it again (this comes up in theft a great deal)

    For the innocent:  A strong denial will be first made, without sensitivity indicators,  and then the conditional is acceptable, but without a strong denial, the conditional is weak and should be flagged as such. 

    DO NOT FORGET:  

    The free editing process versus reflected language.   It is vital in application.   More on this later this evening.

Understanding Layers of Deception


    Question:  Is he a liar or not?

    Answer:   yes, well, no, well, yeah, well, kinda.

    We like things simple and in a neat package.  We want the bad guys to wear black hats and the good guys to wear white hats.   We want conclusions and neatly tied up packages.

    It is not so with detecting deception.

    It is possible for a deceptive person to tell the truth, and a truthful person to lie.  In fact, it happens regularly.

    For the purpose of understanding deception, we classify by the "walk"; something used from antiquity.

    The "walk" of a person is the person's normal patterns in life.  A truthful person normally tells the truth, and for the truthful person, a lie, or deception, is often found in polite responses, or pressure situations.  When a truthful person lies, he or she will often recant, acknowledging the lie.  For the truthful person, the lie is out of character and the conscience will be troubled until the situation of deception is rectified.  Honest people make mistakes, own them, learn from them, and seek to forsake them.

    The "walk", that is, the normal pattern for a deceptive person is to rely upon deception whenever his or her personal comfort levels are threatened.  This is a deceptive person.  

    A sociopath takes this to the ultimate conclusion, which is why lying and murder are related.  The sociopath will tell the truth only when the truth serves his or her own interests.

    Casey Anthony is a sociopath.

    But what of the rest of the family?

    The Anthonys are highly deceptive individuals, who all practice lying, of which has led to their implosion.  The lies are unravelling and all that remains is pain.



    Casey Anthony cannot feel empathy for others, but we do not know the same about the other Anthonys. It may be that the Anthonys have suffered greatly during this trial, with at first, appearing to tell the truth, yet then retreating back into the norm of lies.

    Statement Analysis gets to the truth.

    However, the reader/analyst must understand that the truth is often complexly hidden between deceptive statements.  This can change from day to day, hour to hour, and even sentence by sentence.

    One day, George Anthony testifies and appears to wear the white hat.  The next day, he lies and appears to wear the black hat.  The third day he tells the truth, appears to wear the white hat,  People feel their emotions rise with him, as they watch him cry on the stand.

    Some will say "this was a performance" while others will say "this was genuine pain".

    Statement Analysis goes by the words he speaks and does not need to see him, hear his voice, nor discern his body language.

    In fact, one of the major principles of Statement Analysis is the scientific response:  that is, that analysis done of his statement, no matter where it is done, should produce the same results.   It is often preferred by Analysts that they know nothing other than the allegation, and do not want to be influenced by voice inflection nor personality.

    Sociopaths are often charming and highly persuasive.

    Transcript Analysis is the single best tool to use to get to the truth; far more than any other method.   No matter how something was said, looking down or looking up (which can be useful in other studies), Scientific Content Analysis (SCAN) also known as Statement Analysis or Discourse Analysis, needs only the words employed.

    It is also important to note that when someone does not tell the whole truth, nothing but the truth, they are often called a "liar" for being deceptive.

    For the purpose of analysis, we use "deceptive" rather than "lied" for clarity.

    Here is why:

    A lie is where the subject presents something as reality which is not.  More than 90% of deception does not come from a lie, where something is made up, but comes from information that is withheld.

    "I came into the house,  heard a gun shot, and saw my wife lying in blood. I was upset.  I ran downstairs again.  I found the back door open.  I thought someone must have opened it in a hurry.  I called 911. "


    This is a 100% truthful statement.  There is not a single lie found within it.

    What is missing, however, is critical information.  The subject who spoke this sentence is being deceptive by withholding the identity of the shooter:  himself.  However, in his statement, there is not a single lie.

    This is why we conclude:  "deceptive" or the lesser "unreliable" which helps guide investigators and journalists (and all truth seekers) in how to proceed.


    Regarding George Anthony's responses under oath

    We will do a full analysis of the transcripts to show truthful testimony from deceptive testimony.  Thus far, short analysis has concluded that George, Cindy, Casey and Lee are deceptive people.  Deceptive people hurt others and eventually turn on themselves.  Casey has destroyed her family, beginning with the youngest, in murder.

    Next, she destroyed her father by attempting to blame him for criminal behavior that would have put him in prison.

    By doing so, she has destroyed her father's marriage.

    How?

    Cindy Anthony testified, under oath, falsely.  She did this to save Casey.  Previously, she had attempted to blame others for the murder, but here, she lied to blame herself.

    Lee Anthony contradicted her testimony, and there will now be an even larger, perhaps lethal rift between them.

    George refused to follow Cindy's lead and has even now gone as far as to say that he believes Casey murdered Caylee.

    The jury heard this, in so many words, because of the folly of Casey's attorney.

    Deceptive people, like the Anthonys and like Jose Baez, like when people throw up their hands and say "I don't know who to believe or what to believe!" and give up the quest for truth.

    Statement Analysis asks the reader to put down the hands of surrender, and carefully view what each has told us and we will get to the truth.

    Readers want to know:

    Question:   Did George Anthony tell the truth?

    Answer:   The answer needs qualification.  It is a sensitive question.  

    George told the truth to some questions, and he was deceptive in his answers to other questions.  This is the same response for Cindy Anthony and Lee Anthony, and yes, we can know which answers were truthful, which were unreliable, and which testimony was deceptive.  It takes time.

    For some readers, George will wear the white hat, and for others, he will wear the black hat.

    The analyst, or truth seeker, must be willing to see George Anthony frequently swap hats, and accept the complexity of the situation.  Listening to a highly deceptive person can be exhausting but truth seekers must endure in order to find specific responses.

    Thanksgiving lighting ceremonies like the one at Lenox Square Mall has hosted “Idol” contestants in the past, including George Huff and Katharine McPhee. New Year’s is probably the biggest one and anybody with a half-decent name should be able to get a decent paycheck that day.

    Folks who host July 4th fireworks celebrations often like to spend a few extra bucks on big-name entertainment. This year features two “Idol” alums at two different fireworks events. Diana DeGarmo will be at Lenox Square, as reported a few days ago. I just heard on Q100 (a sponsor) that another “Idol” runner-up Crystal Bowersox will be headlining the Centenntial Olympic Park festivities. (Last year, they had the Smithereens.)  She begins performing at 8:30 p.m. before the fireworks.

    And what’s best: it’s free! “The Voice” duets tomorrow: Dia Frampton and Miranda Lambert (Blake’s wife). Steve Nicks is paired with Javier Colon. Train’s Pat Monahan sings with Vicci Martinez. Ryan Tedder (OneRepublic lead singer who was on “Platinum Hit” last night) will duet with Beverly McClellan.

    Katharine McPhee Introduces Viewers to Smash Is NBC looking at TV's next big smash? Katharine McPhee sure hopes so.

    The former American Idol finalist jumped ship last night and showed up on the performance finale of The Voice. She talked to Carson Daly in the audience and hyped the network's upcoming drama, Smash, which will be paired with The Voice in 2012.

    The series can most easily be described as an adult version of Glee, as it focuses on the production of a Broadway musical and stars McPhee, Debra Messing and others. But I've seen the pilot and that would be doing Smash a disservice.

    Yes, there's singing, but it's easily the best new show of the 2011-2012 season for numerous reasons. A mature drama with sharp dialogue, quick pacing and layered characters, Smash premieres in January. Watch an extended ad for it here.

Cindy Anthony: Perjury Again

                                                 Cindy Anthony perjured herself...again.

    We will have to wait to see what comes of Lee Anthony's impeachment of his mother's testimony.  Lee likely did not have to wait to know the wrath that awaited him.

    Jose Baez asked her if she sent out private investigator Dominic Casey to the wooded area near the home. Cindy denied doing so.

    Then Baez asked her is she told Yuri Melich that she sent someone down by the woods and they came up with nothing. Cindy denied this as well. It was an attempt to cover for Casey.

    Cindy Anthony did not send out Dominic Casey on a tip from a psychic, Cindy Anthony sent out Dominic Casey to gloss over the perimeter only in an attempt to show police that Caylee wasn't there, to protect Casey. This is the same reason why she allowed Texas Equasearch to travel from Texas to Florida with all their equipment, only to sabotage search efforts.

    Dr. Lillian Glass points out the indicators of her deception at her blog. She wrote, "Then Jose asks if they were looking for a blanket, Cindy then gives way too much information about a Winnie the Pooh blanket and 70 items. It was not called for. When people give too much information that is not requested it usually means the person has something to hide."

    This is correct. The additional information is often given as an attempt to move the topic away from the sensitive area in an effort to change the subject at hand.

    When Lee Anthony got on the stand, he testified that he and his mother fought over her sending out the private investigator to the woods.

    Cindy Anthony knew, once Casey was out on bond, where Caylee's remains were. This is why she told the media, after kicking out Tim Miller

    "George and I don't believe Caylee's in the woods or anything."

    Cindy is a woman who is used to speaking up for herself. Here she needed to bring George's name into it, but actually introduces the topic "in the woods" to the media. This was the signal that Caylee was in the woods and she was "close", as Casey said she was from the jailhouse.

    Caylee's remains were found in the woods, less than a quarter mile from the Anthony home, a few months later.  Cindy Anthony allowed her precious grandchild's remains to be devastated by the elements as she travelled and dined at the finest hotels.

    Casey inherited her coldness from her mother.

    Dr. Glass wrote: As Lee spoke he was forthright. It was clear Cindy lied. She is despicable. I hope Linda or Jose files charges against her for lying. She cannot get away with this.

    The anger of the public which rested upon Cindy Anthony for so long, only to be abated when she testified in May, has returned. No one likes to be lied to and no one likes a liar.

    Katharine McPhee gets a record deal tied to NBC’s ‘Smash’ Katharine McPhee, the star of the upcoming NBC show “Smash,” is getting her own record deal with Columbia Records, the network revealed Thursday.

    UNIVERSAL CITY, Calif.NBC and Columbia Records have agreed to a recording rights deal for the soundtrack of NBC’s new musical series “Smash” and series star Katharine McPhee also signed a solo recording deal with Columbia Records. “Smash” - starting mid-season on Mondays (10-11 p.m. ET) on NBC — stars Debra Messing (“Will & Grace”), McPhee (“American Idol”) and Oscar winner Anjelica Huston (“Prizzi’s Honor”). The announcements were made by Robert Greenblatt, Chairman, NBC Entertainment, and Rob Stringer, Chairman, Columbia/Epic Label Group. The arrangement guarantees worldwide, digital and physical rights to the first season of “Smash” with successive options to subsequent seasons.

    “A musical series should naturally be accompanied by a soundtrack deal, and NBC is very excited to be working with the best. Our Columbia Records partners will guide the soundtrack of ‘Smash’ into a big component of the show’s success,” said Greenblatt. “The music will be a driving force of what promises to make a tremendous impact for NBC in January and we couldn’t have asked for better expertise and strategy than this company will provide.”

    “Smash” is a musical drama that celebrates the beauty and heartbreak of the Broadway theater as it follows a cross-section of dreamers and schemers who all have one common desire — to be a “Smash.” The soundtrack will be both original compositions by Marc Shaiman and Scott Wittman, the Tony and Grammy Award-winning songwriters of Broadway blockbusters such as “Hairspray” and “Catch Me If You Can,” as well as covers of a variety of existing hits that will combine to tell the narrative of this musical series. McPhee’s career launched with her renowned run on “American Idol” in 2006 in which she was the runner-up on the fifth season. Her self-titled debut album “Katharine McPhee” was released in January 2007 and premiered at the #2 spot on the Billboard 200. The first single from the album, “Over It,” was a Pop Top 30 hit and was certified gold in 2008.
     
    “Unbroken,” McPhee’s second album, was released in January 2010 and debuted at #27 on the Billboard 200. The album included the single “Had It All,” which crested at #22 on the Billboard Adult Contemporary chart. McPhee has already had success with Christmas releases from her 2007 single “O Come All Ye Faithful” and “I’ll Be Home for Christmas” in 2009.


    In addition, she has appeared frequently on television around the holidays, including a guest appearance on the annual “Christmas in Washington” television special as she performed for the First Family, and the “My Christmas” concert starring Andrea Bocelli. Last year, the sensational singer released some of her favorite Christmas songs for her third album, “Christmas Is the Time…To Say I Love You.” The single “I’ll Be Home for Christmas” was a huge hit, and was downloaded over 500,000 times exclusively on iTunes.
