Cheney Mason told the court that Casey Anthony was lied about and maligned by the prosecution and that she was a "dedicated, loving mother" and that there is no evidence of any injuries upon Caylee's body.
Question: in the name of protecting a client, is it appropriate or acceptable for a lawyer to lie?
Mason argued with arm motions and appeared "feisty" according to Ryan Smith of In Session (HLN) and in the end, Judge Perry denied the motion to acquit Casey Anthony, as Prosecution has rested its case and now, beginning on Thursday, June 16, the defense will present its witnesses.
The defense previously asked Judge Perry to make an apology of sorts to the jurors by reminding them that the defense did not need to call any witnesses.
In a heated exchange Judge Perry said that the defense lied to him therefore, but Mason answered that he did intend to call witnesses.
Mason wanted it both ways:
He wanted the judge to say that the defense didn't have to call witnesses, since the judge was giving encouraging words to a tired jury, but then he wanted to call witnesses.
This underscored how weak the defense case is.
In spite of the attempt to churn emotions, Mason did not speak from the heart, but read his prepared statement.
Judge Perry was right with him on each case sited.
The circus continues now, with the defense witnesses.
Although the burden of proof rests with Prosecution, given Baez' opening statement, they have placed themselves under a de facto burden of proving that this was an "accident" that not only went unreported, but it was an accident of which Casey Anthony was willing to sit in jail for 3 years over.
